These Terms of Service (“Terms”) govern your access to and use of cathcart.com (“the Site”) and any content, programs, products, or services offered by Cathcart Institute, LLC (“Cathcart Institute,” “we,” “our,” or “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Acceptance of Terms

By browsing, registering, submitting a form, purchasing a program, or otherwise using the Site, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We may update these Terms from time to time. Material changes will be announced on the Site and will take effect no earlier than 14 days after posting. Continued use of the Site after the effective date constitutes acceptance of the updated Terms.

2. Use of the Site

You agree to use the Site lawfully and in good faith. You agree not to:

  • Use the Site in any way that violates applicable federal, state, local, or international law
  • Attempt to gain unauthorized access to any part of the Site, its servers, databases, or connected systems
  • Interfere with the operation of the Site, including by introducing malware, launching denial-of-service attacks, or scraping at a scale that burdens infrastructure
  • Use automated means (bots, scrapers, crawlers) to extract content at scale without our prior written consent, except for standard search engine indexing
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity
  • Harass, abuse, or harm another person through the Site or its forms
  • Submit false or misleading information through any contact or registration form

We reserve the right to suspend or terminate your access to the Site at our discretion, particularly in cases of suspected abuse, fraud, or violation of these Terms.

3. Intellectual Property

3.1 Our Content

All content on the Site — including text, articles, blog posts, podcast episodes and transcripts, videos, images, photographs, graphics, logos, layouts, and audio — is the property of Cathcart Institute, LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and share content for personal, non-commercial purposes with attribution. Any other use, including reproduction, distribution, modification, public performance, public display, or creation of derivative works, requires our prior written permission.

3.2 Trademarks

“The Acorn Principle” and “Cathcart Institute” are trademarks of Cathcart Institute, LLC and/or Jim Cathcart. “Certified Professional Expert” and “CPE” are certification marks used under Cathcart Institute’s certification program. You may not use these marks without our prior written consent, except for fair-use reference in editorial or scholarly contexts.

3.3 Books and Publications

Jim Cathcart is the author of numerous books, including but not limited to The Acorn Principle, Relationship Selling, and Mentor Minutes. Copyright in these works is held by Jim Cathcart and/or his publishers. Excerpts and quotations available on the Site are provided for informational and promotional use; full-text reproduction requires permission from the copyright holder.

3.4 Third-Party Content

Some content on the Site (quotes, photographs, video clips, testimonials) is used with permission from the original authors, speakers, or rights holders. All such content remains the property of its respective owners.

4. User Content

If you submit content to the Site (for example, through a contact form, a testimonial, a comment, or other interactive feature), you:

  • Represent that you own the content or have the necessary rights to submit it
  • Grant Cathcart Institute a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute that content in connection with the Site, our marketing, and our programs
  • Agree that we may edit the content for length, clarity, or accuracy before publishing it
  • Understand that we are not obligated to publish or retain any user content, and may remove it at any time for any reason

You are solely responsible for the content you submit. Do not submit anything you would not want attributed to you publicly.

5. Programs, Products, and Payments

The Site offers and/or references paid programs, including the Certified Professional Expert (CPE) program, Going Pro Experience, Strategic Mentorship, Professional Experts Summit, Cathcart Institute Asia, keynote speaking engagements, and self-study products.

  • Pricing, scope, and availability are as stated at the time of purchase. We reserve the right to change pricing prospectively.
  • Payments are processed through third-party payment processors. We do not store full payment card numbers on our servers.
  • Refund and cancellation policies for specific programs are disclosed at the point of purchase or in a separate program agreement. Those program-specific terms govern the transaction and supersede these Terms with respect to refunds, cancellations, and service delivery for that program.
  • Speaking engagements are governed by a separate signed speaker agreement between Cathcart Institute and the booking entity.

6. Third-Party Links and Services

The Site contains links to third-party websites and services, including Amazon (book retailers), YouTube, podcast platforms, LinkedIn, and others. We do not control these external sites and are not responsible for their content, terms, privacy practices, or availability. A link from our Site does not imply endorsement of the linked site.

7. Disclaimers

The Site and all content, programs, and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Cathcart Institute disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

Information on the Site is provided for general educational and informational purposes. It is not professional, legal, financial, medical, or psychological advice. Results described in testimonials and case studies are individual and are not guarantees of future results. Your professional outcomes depend on many factors outside our control, including your own effort, circumstances, and market conditions.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

8. Limitation of Liability

To the maximum extent permitted by law, Cathcart Institute, its officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, use, goodwill, or other intangible losses, arising from or relating to your use of or inability to use the Site, any content, or any program.

Our total liability for any claim arising from or relating to the Site or these Terms will not exceed the greater of (a) the amount you paid to us in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). This limitation applies regardless of the legal theory of the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To that extent, the limitations in this section may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Cathcart Institute, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, publicity, or privacy rights; or (d) any content you submit to the Site.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws provisions. You agree that any claim or dispute arising from or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

If you are a consumer residing outside the United States, nothing in this section is intended to deprive you of mandatory consumer protections available to you under the laws of your country of residence.

11. Changes to Terms

We may revise these Terms at any time by posting an updated version on the Site. The “Effective Date” at the top of these Terms will reflect the most recent revision. Material changes will be announced at least 14 days before they take effect. Your continued use of the Site after that date constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and any program-specific agreements referenced at the point of purchase, constitute the entire agreement between you and Cathcart Institute regarding the Site.
